国际仲裁界“奥林匹克大会”20年后再回中国
这一次，为何选择香港？

20年后，被称为国际仲裁界“奥林匹克大会”的国际商事仲裁理事会大会(ICCA Congress)再次回到中国。上一次，是北京；这一次，是香港。5月5日至8日，这一大会将在香港举行。
香港国际仲裁中心(HKIAC，以下简称港仲)，是这次大会的承办者。港仲秘书长刘煦婷(Joanne Lau)近日在接受《法治日报》记者采访时表示，国际商事仲裁理事会(ICCA)选择香港意义重大，可以说“是对香港在解决国际商事争议方面具有举足轻重地位的认可”。
公开资料显示，国际商事仲裁理事会是一个全球性的非政府组织，致力于促进仲裁、调解及其他争议解决方式的发展。国际商事仲裁理事会大会作为仲裁界交流和互动的最主要平台之一，是最高水平的国际仲裁会议，也是国际仲裁领域规模最大的盛会，大会代表是来自世界各地的仲裁员、律师、法官等。
如此重要的国际仲裁会议承办权，何以能够为港仲所申请到？刘煦婷告诉记者，这首先得益于亚洲尤其是中国的经济繁荣。在竞标书中，港仲写道：亚洲尤其是中国对外投资不断增加，经济交往日益活跃，商事纠纷解决需求也随之增加。“我们还特别谈到了‘一带一路’倡议及其在全球的重要性。”刘煦婷说。
刘煦婷特别强调，香港特别行政区政府的大力支持是选择香港为大会举办地点的一个关键因素。“我们要感谢香港律政司的大力支持。此外，还要感谢司法部对港仲承办本次大会的支持。”为支持香港特区办好本次大会，司法部委派专人来港参会，同时鼓励各地涉外仲裁机构、有涉外法律服务的律师事务所报名参加。
据了解，其他一些因素也在这次申办成功上起了重要作用。在港仲的竞标书中还强调了如下方面：香港是《联合国国际商事仲裁示范法》的司法管辖区，也在《承认与执行外国仲裁裁决公约》(《纽约公约》)的框架之内，拥有声誉良好的仲裁机构、先进的设施以及世界级的仲裁员和从业人员，香港已拥有世界领先的仲裁地位；香港也是一个繁荣的仲裁社区所在地，在立法者、法官和律师等群体的共同努力下，在许多新兴的仲裁管辖区推广国际仲裁最佳实践；香港是一个重要的金融中心和商业中心，拥有许多世界领先的公司、金融机构和专业服务组织等等。
值得注意的是，港仲此前就公开表示，希望这是一个香港的活动，而不仅仅是港仲的活动。这是宣传香港作为国际商事争议解决中心的一个非常好的机会。“我们希望香港和港仲将继续在国际仲裁界发挥引领和示范作用，而这次会议就是展示我们引领和示范作用的好机会。”刘煦婷说。
刘煦婷透露，目前已有近1200人注册参加此次会议。
据了解，港仲1985年成立，提供仲裁、调解、审裁和域名争议解决服务。港仲也是《香港仲裁条例》下法定的、唯一的、以香港作为仲裁地的临时仲裁的委任机构。除此之外，港仲还是亚洲域名争议解决中心的常设秘书处和香港办公室。2015年，港仲作为全球首家境外机构在中国内地设立代表处。港仲亦是《关于内地与香港特别行政区法院就仲裁程序相互协助保全的安排》下符合资格的仲裁机构。2022年6月，港仲作为首家境外仲裁机构加入中华人民共和国最高人民法院国际商事法庭“一站式”国际商事纠纷多元化解决平台。根据英国伦敦玛丽女王大学和美国伟凯律师事务所联合发布的《2021年国际仲裁调查》，港仲获评全球第三受欢迎的仲裁机构。(法治日报)
